Your Legal Rights During Police Questioning in Uttar Pradesh

Under Indian law and the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), individuals subject to police questioning or arrest at police stations in Lucknow and across Uttar Pradesh have defined legal rights. Upon arrest, the police are required to inform the arrested person of the grounds of arrest and their right to be released on bail where applicable. An arrested person cannot be detained for more than 24 hours without being produced before a Magistrate — this is a fundamental right under Article 22 of the Constitution of India. The arrested person has the right to have one person — a friend, relative, or nominated person — informed of their arrest and the place of detention. Every arrested person has the right to consult a legal practitioner of their choice. Under the BNSS, a woman cannot be arrested after sunset and before sunrise except in exceptional circumstances and only with the written permission of a Judicial Magistrate of First Class. Women are not required to appear at a police station for questioning — statements may be recorded at their residence. In Lucknow, if rights are violated during arrest or questioning, a complaint may be made before the Magistrate or the Senior Superintendent of Police (SSP), Lucknow.
